When you join the O2 Living online community, you will be asked to register and provide us with basic information about yourself. You will also be agreeing to receive information, updates, and announcements from us on a monthly basis. At no point will we ever share, sell, or transfer your personal information to any party, except those third party vendors, suppliers, manufacturers, distributors, delivery providers and other entities that are utilized by O2 Living to meet the needs of the products, and/or services your request through our Ordering and Delivery features subject to the O2 Living Ordering and Delivery policies.
Cookies; O2 Living uses standard web site technology which is generally referred to as cookies. Cookies are small data files that are assigned to and stored in your computer’s hard drive. Cookies allow O2 Living to analyze and understand online behavior and define which areas of the site are most popular. Much of the future site content will be based on our data collection and analysis.
Information Provided in Public Forums
Going forward, O2 Living will add real time chat rooms, message boards and other public forums. These chat rooms, message boards and other public forums will allow members to discuss, express and publish wellness matters and other health related issues. In addition, an O2 Living expert will respond to member questions. Any information you provide in the aforementioned forums will not be considered private and can be used by any party who is viewing them. This would also apply to discussions hosted by wellness and health experts and information provided on the Ask the Expert feature. Even information that is personally identifiable, including your own personal health information, will no longer be considered private and can be used by any party who is viewing said aforementioned chat rooms, message boards and other public forums, Ask the Expert feature or discussions hosted by wellness and health experts. Please exercise discretion and care when providing personally identifiable or personal health information in these public forums.
By providing your personally identifiable information and or your personal health information in the O2 Living chat rooms, message boards and other public forums, Ask the Expert feature or discussions hosted by wellness and health experts, you hereby waive any privacy claims over said information and agree to indemnify and hold harmless O2 Living, O2 Live LLC, Cross River Wellness LLC, Cross River Retail, LLC, Yellow Monkey Food Service LLC and all shareholders, employees, third party contractors, third party vendors, assigns, heirs and all successors in interest of O2 Living, O2 Live LLC, Cross River Wellness LLC, Cross River Retail, LLC, Yellow Monkey Food Service LLC from any and all claims and damages concerning any aspect of the use of said personally identifiable and or personal health information. By providing said personally identifiable information and or personal health information in the aforementioned chat rooms, message boards and other public forums, Ask the Expert feature or discussions hosted by wellness and health experts you herby consent to the use of this information for any reason by O2 Live.
Business Operational Transfers
In addition, O2 Living and any or it’s affiliated business entities may choose to sell it’s business to another party. Your personal information may be considered part of the business assets which are transferred to another party. The acquiring party would acquire and exercise domain over your information if in fact O2 Living sells its business to said party. If the aforementioned sale is not consummated, the acquiring party, their accountants, lawyers and other professional advisors may examine your personal information as part of the due diligence for the proposed transaction.
O2 Living may be required to share your personal information in response to subpoenas, court orders, discovery requests, government investigations, legal transactions and other legal proceedings. This disclosure may be done without your notice or consent. In addition, we may also use device identifiers, including IP addresses, to identify users. This procedure can be implemented by O2 Living due to cooperation with copyright owners, internet service providers, wireless service providers or law enforcement agencies. This procedures may be done without your consent or without notice to you.
O2 Living will deploy all commercially reasonable measures to secure your personal information. Yet it is important to note that technology has not evolved to the point that all electronic transfer of data over the Internet protocols can be transmitted or stored in a manner which can be 100% secure. As such O2 Living can not ensure or warrant the absolute security of any information you submit to O2 Living and you make said transfers at your own risk.
Updating, Changing, and Removing Information
O2 Living is dedicated to protecting your personal information and ensuring that your experience with O2 Living is a positive one. If you have a complaint or concern, please advise us and a member from our customer support team will respond to your concerns as promptly as possible.
Removal of Your Personal Information
The goal of O2 Living is to protect your personal information and privacy. If for any reason you want to delete your account, simply go to your membership page and follow the instructions on deleting your account.
Personally identifiable information provided by children
O2 Living is committed to the wellness of children. We are respectful of Parent and Guardian concerns for the privacy of their children. We do not knowingly collect any personally identifiable information and/or personal health information from children who are under the age of 13 years old. We will delete any personally identifiable information and/or personal health information that we later discover was provided by a child under the age of 13 years.
Personally identifiable information provided by parent or guardian
We do allow and encourage parents and guardians to utilize the O2 Living web site features to develop wellness practices for their children. The parent or guardian may provide us personally identifiable information and or personal health information concerning their child under the age of 13 years. If in fact a parent or guardian does provide said information, then O2 Living reserves the right to utilize said information in manner previously described in paragraphs II (a) − (e), III (a) − (d), and IV (a) & (b).
Responsibilities of the parent and or guardian
Further it is the responsibility of the parent or guardian, and said parent or guardian assumes all responsibility for any use by said child under the age of 13 years on the O2 Living website and any of its products and or services offered therefrom.
